A MAN who helped to dig up flagstones in a midnight attack on a Brierfield street was jobless and penniless.
Burnley Magistrates were told how Michael Brierley, 27, had been approached by somebody asking if he wanted to make "a few quid".
Brierley, of Wood Street, Brierfield, admitted theft of four flagstones and was conditionally discharged for 12 months, with £30 costs.
An allegation of attempting to remove 12 flagstones was withdrawn.
Andy Robinson, prosecuting, said officers were on Sefton Street, Brierfield, and the defendant was with another man removing flags.
Both men ran off but Brierley was caught.
John Rusius, defending, said Brierley was of good character.
He was asked by somebody if he wanted to make a few quid and took the opportunity because he was strapped for cash.
