A DRINK-driver stopped by police while more than twice over the limit had a child in the car with him.
Stephen McIlmoyle, 34, had been taking his son home from a barbecue when he was pulled over by police.
Burnley magistrates court heard that McIlmoyle had not been driving badly, but police had stopped him at the request of his former partner.
The defendant, of Oak Street, Colne, admitted drink driving on May 25.
The bench said the child had been at risk, as had other road users and pedestrians.
David Lawson, defending, said McIlmoyle had a young son and had an informal contact arrangement with his ex-partner.
He had been to a barbecue not anticipating driving, but his former partner had then rung and said she wanted the child back home. She said she would call the police if the boy was not returned.
When stopped, he gave a test showing 71 microgrammes of alcohol in 100 mililetres of breath - the legal limit is 35.
He was fined £230, with £60 costs and a £15 victim surcharge and banned for 20 months.
