A MAN who dumped rubbish in black bin liners outside his house has been fined for failing to properly dispose of household waste and not recycling.

Frank Dempsey, of Castle Street, was fined £150, with £100 costs, after being found guilty of breaching a notice telling him he must recycle and throw away his waste correctly.

The case proceeded in his absence and he failed to appear at Reedley Magistrates' Court.

In December 2006 the council was told about seven black bin bags of rubbish outside Mr Dempsey's property.

Enforcement officers found a mix of recyclable waste, which should have been in the various recycling boxes/bags, when they visited his property.

General household waste was also discovered but not in grey wheeled bins.

A letter found in one of the bags linked the waste to Mr Dempsey.

A notice was later served on him telling him that he must put household waste out for collection in a wheeled bin.

In November 2007 the council received another complaint about waste outside Mr Dempsey's home, and again the waste was linked to him.

The council issued a fixed penalty notice for £100 to Mr Dempsey, but he did not pay it.

Passing sentence, the chairman of the magistrates' said the court regarded the case as "disgusting and anti-social".

Carole Taylor, Waste Services Manager, said: "Mr Dempsey had a chance to right his ways and put his rubbish and recycling out for collection in the right container.

"He chose not to take any notice of our warning.

"I expect this fine will make sure he puts his rubbish and recycling out properly in the future."
