A MOTORIST found in possession of cannabis refused to give a sample of blood.

Blackburn magistrates heard Kaman Man told police he had a fear of needles and blood but magistrates convicted him after a trial of deliberate refusal.

Man, 43, of no fixed address, pleaded guilty to possession of cannabis and was convicted of failing to provide a specimen for analysis. He was fined £150 with £350 costs and £30 victim surcharge and banned from driving for 15 months.

Andy Robinson, prosecuting, said Man was stopped by police at 11.55 am and they could smell cannabis. He initially denied having any but then handed over a small tub containing cannabis. He told the officers he suffered from depression and anxiety which was why he smoked cannabis.

John Morris, defending, said his client's medical records confirmed that he had issues with needles and blood although they also confirmed that in the past he had given blood.

"He did indicate there was an issue at the roadside and it wasn't just something he dreamt up as a defence," said MR Morris.
