TWO brothers who burst into a house and carried out a planned attack, in which their victim was seriously injured, have been jailed.
Michael Ashe, who was on licence from a two-year jail term for violence, had gone armed with a baseball bat and had set about Terry Thompson, leaving him with a broken elbow.
His brother, Ryan Ashe, had hit the victim with his fists, causing injuries to his head and body.
Mr Thompson, an epileptic, later had to have surgery to his arm. The brothers had gone to 'mete out some form of justice' after Mr Thompson was said to have assaulted their uncle, Burnley Crown Court heard.
The hearing was told how Ryan Ashe was masked, but householder Deborah Moss knew him well and asked him: “What have you got over your face?”
Shanie Hyde, 21, who followed the men into the property, assaulted Mrs Moss after she tried to get rid of the the brothers.
Hyde, who was on a suspended sentence at the time and has been given an anti-social behaviour order in the past, caused bruises to Deborah Moss's face, head and shoulder when she pulled her to the floor, kicked and stamped on her.
Michael Ashe, 24, of Wycoller Avenue, and Ryan Ashe, 18, of Albert Street, both Burnley, had been convicted of inflicting grievous bodily harm, last November.
Michael Ashe was jailed for two years. Ryan Ashe was sent to detention for 18 months.
Hyde, of Wycoller Avenue, was convicted of assault causing actual bodily harm and was spared custody. She was given 44 weeks in prison, suspended for a year, with 12 months supervision.
The court was told Hyde started offending when she was 15, had a record for assault and battery and had previously been made subject to an ASBO. Ryan Ashe had convictions for robbery and burglary and Michael Ashe had a record for assault and possessing an offensive weapon.
Sentencing, Judge Beverley Lunt told the defendants: “This was a premeditated, joint attack by the three of you.”
The judge said Michael Ashe caused the fracture by wielding the baseball bat. Ryan Ashe had a “dreadful record for somebody so young.”
Judge Lunt told Hyde: “Your victim is lucky indeed that you didn't case her serious injuries." She added: “You seem to have done some growing up. Keep doing that.”
