THE families of two Pendle youngsters who impaled their hands on the same metal fencing are seeking legal action.

Hassan Hussain was playing near to his home in Every Street, Nelson, when his football went over the fence on the site of the former St Joseph’s RC Church.

As the seven-year-old attempted to climb the five-and-a-half foot fence he slipped and impaled his hand.

This accident mirrors that of Lomeshaye Primary School pupil Zeeshaan Ashraf, 10, who ripped the tendons and damaged nerves in his hand as he also tried to retrieve his ball just a few weeks earlier.

Despite calls by their families and support from the community to remove the fence, Pendle Council said it would not be moved as it was designed to keep people out of the site.

Zeeshaan’s uncle, Javed Ashraf, who lives with his nephew in Victoria Street, Nelson is now seeking legal advice to force the council to do more.

He said: “The whole community is backing my family and Hasan’s family in calls that the council should replace the fencing.

“We know children shouldn’t climb over it but they do. They are only children.

“We have know been to see a solicitor to see how we can take this matter further.”

Whitefield Primary School pupil Hasan went back to school yesterday after the accident 10 days ago.

His dad Asif Hussain said: “I feel like we have been left with no option but to seek legal advice as the council and the Health and Safety complaints committee have failed to get back to me.

“My main concern is that another child could get hurt on this fencing. What if next time the spike goes through a child’s chest.

“I feel really insulted that the council think its okay to tell me to educate my child. Hasan will never go near that fence again but another child will.

“We will fight this until the end.”
