XANADU developers are forcing an inquiry into plans about Kenyon Station because planners have delayed their decision.
Warrington Council planners want more consultations about the Xanadu developers' Manchester-Liverpool rail link proposals and for the second time have deferred their station plan.
The proposed station - which Xanadu developers admit is a vital ingredient in their Leigh leisure complex plans - lies within Warrington boundaries.
Cllr Terry O'Neill, chairman of Warrington Council's planning committee said even if the Council favoured approval of a station at Kenyon it would have to be referred to the Secretary of State.
Chris Baybutt from Greenbank Partnership confirmed to The Journal that they were appealing against Warrington's non-decision.
And the developers hope the Xanadu inquiry inspector Morris Turner will be able to hear evidence on the Kenyon Station proposals when the hearing resumes in September.
