A DRINK driver's insurance ran out five days before he was breath tested, Burnley magistrates heard.
Andrew Perry, 27had 55 microgrammes of alcohol in 100 millilitres of breath - the legal limit is 35.
Perry, of Lebanon Street, Burnley, was fined £280, with £55 costs, and was banned from driving for 12 months. He admitted driving with excess alcohol and no insurance.
The court heard Perry told police he was sorry, he had learned his lesson and it would not happen again.
Perry had no previous convictions.
He had gone out for a drink in Burnley and should have walked home and left his car.
Perry worked at Silentnight in Barnoldswick and needed his car to visit family in Birkenhead at weekends.
