PUB customer John Morris struck the wrong chord when he criticised the music played by the DJ in the Grapes, in Northgate, Blackburn.

The town's magistrates heard that the man spinning the discs was needled by the comments and pushed him against a waiting taxi. But the court heard there was a B side to the story which would have to be resolved by both parties giving evidence.

Mark James Fitzsimmons, 28, of the Sun Hotel, Church Street, had pleaded guilty at a previous hearing to assaulting Mr Morris, causing him actual bodily harm.

After hearing that there were two totally different stories relating to the incident and disagreement over issues of injury and compensation, magistrates adjourned the case until August 31.

John Woods, prosecuting, said Mr Morris's version of events was, he had been in the Grapes and, at the end of the night, was standingstood outside talking to a member of staff while waiting for a taxi.

As the taxi pulled up, he said: "The DJ was rubbish tonight" and he immediately felt a violent push from behind. Mr Morris banged his head against the taxi roof and his shin on the sill and as he looked round saw Fitzsimmons standing with his fists clenched. He claimed to have lost a tooth in the incident and also claimed £320 compensation for his glasses.

Roger Pickles, defending, said Fitzsimmons had been working as the DJ and at the end of his session had sat down to enjoy a drink with his girlfriend.

Morris approached them and said the music had been no good. "My client responded verbally and the complainant walked out of the pub," said Mr Pickles.

"Minutes later he came back in and continued this tirade of abuse against my client and his girlfriend.

"My client asked what his problem was and then followed him outside, where he accepts that he pushed him."
