A MAN was arrested for the second time within a week for breaching an anti-social behaviour order by being under the influence of alcohol.
At Blackburn Magistrates Court Jimmy Lee, 41, of Limbrick, Blackburn, pleaded guilty to a breach of the ASBO.
He was fined £100 which was set against the two nights he had spent in custody.
Michael Blacklidge, defending, said the order had been imposed to prevent anti-social behaviour in the town centre and there had not been any when Lee was arrested on Monday and Wednesday nights last week.
He said: “There was a downpour of biblical proportions on Wednesday night and my client was making his way home like a drowned rat.
“When he saw the police he vaulted over the central barrier on Barbara Castle Way so he can’t have been that much under the influence.
“Had he not been arrested he would have walked the 50 yards to his home address and nobody would have been disturbed and nobody would have been any the wiser.”
