A DRUNK football fan who told a punter he was ‘tooled up’ and ‘ready to give someone a Glasgow kiss’ ahead of a Burnley FC game has been spared jail.

Burnley Crown Court heard how 46-year-old Jason James McCabe had been in The Brickmakers Arms, close to Burnley’s Turf Moor Stadium, at 3.05pm on December 23 when the incident happened. Burnley were due to play Tottenham Hotspur at 5.30pm.

Prosecuting, Charles Brown said McCabe who was ‘worse for wear through alcohol’ turned to a man in the pub and said: “I am tooled up and ready today for the football. Got my friend Stanley with me. Going to give someone a Glasgow kiss.

“Me and my friend Stanley are going to cut someone.”

The court heard how McCabe, of Stockbridge Road, Padiham, was reported to door staff who ejected him from the pub and into the custody of a waiting police sergeant.

McCabe admitted to being in possession of a weapon, which turned out to be a scalpel rather than a Stanley knife.

When he was interviewed by police McCabe said he had the scalpel because he had been attacked by dogs in the past.

McCabe, who has two previous convictions for being drunk at a sporting event, pleaded guilty to having a bladed article and using threatening behaviour with intent to cause fear or violence.

Defending, Howard Shaw said his client was a Burnley fan but did not regularly attend matches.

He said he had decided to go to the game on that particular day and his behaviour was nothing more than drunken bravado.

Mr Howard said: “It was drunken mouthing off in a public house. The knife wasn’t produced. No direct threats were made to anybody.

“He is not a football hooligan.”

Judge Andrew Woolman said: “The court does have the power to lock you up for a short period of time. It seems to me that because you are 46 and you have not been in trouble for years that would be an inappropriate way of dealing with you.”

McCabe was sentenced to a 12-month community order.

Judge Woolman decided against imposing a football banning order.
