A 31-YEAR-OLD man who gave a breathalyser reading of 90 against the legal limit of 35 was stopped again five days later and claimed he couldn't provide a sample because he had asthma.
Raal Janusz Oles, 31, of The Ferns, Ashton on Ribble, Preston, pleaded guilty to driving with excess alcohol on February 24 and not guilty to failing to provide a specimen on February 26.
A trial was set for the second offence and the first adjourned for sentence on the same day.
Catherine Allan, prosecuting, said the defendant was saying he had medical reasons for failing to provide despite providing a positive sample on the first occasion.
