'Not enough warning signs', says smoker after he is fined £50 for dropping cigarette end

A SMOKER who was given an on-the-spot fine for dropping a cigarette butt says there are not enough warning signs in Bolton town centre.

Marcello Garbini is making preparations to move to Bolton from Newbury in Berkshire, and was here to search for a house.

But a trip to the town centre cost him £50 after an enforcement officer “frogmarched” him to Bolton Town Hall to pay up within 13 minutes of the offence — despite him picking up the cigarette end.

But Bolton Council says there are plenty of bins in the town centre — all with signs “promoting the responsible disposal of rubbish”.

The offence was committed at 11.55am on May 21 outside Crompton Place shopping centre and Mr Garbini had paid the fine by 12.08pm.

Mr Garbini, who is originally from Italy, said: “I came into town just for a look around as I am moving to the area.

"I went over to Crompton Place and before the cigarette butt hit the ground I was being frogmarched over to the town hall to pay £50.

“He was watching me and knew it was an easy catch for him. He told me it was an offence in Bolton to drop cigarettes — but there are no signs up to tell people who don’t live around here.”

Mr Garbini, who walks with a cane, said: “I even picked the cigarette up and put it in the bin but he said he was still going to fine me.

“He said, ‘you’re not going to run away are you?’ and I said ‘I can’t run anywhere even if I wanted to’.

“I have a crushed disc in my back and had an operation to remove it and I’ve used a walking stick ever since.

“I have never broken any law before and I have never heard about this law. It’s ridiculous.

“There are no signs up in the town centre — it’s just an easy money maker for the council to fine smokers. Freedom of choice has gone out of the window.

“My partner and I are looking to move to Bolton — she’s from Astley Bridge — but this has made us think twice about it.

“I think if they’re going to fine smokers, they shouldn’t on a first offence. I paid that fine within just 13 minutes of dropping the cigarette — it must be the quickest ever paid.”

A spokesman for the council said there had been several high profile campaigns to educate people about anti-littering such as its Love Bolton Hate Litter campaign.

He added: “The message is getting across. There’s also a large number of bins in the town centre which are clearly signed to promote the responsible disposal of rubbish.

“While a cigarette butt may seem small, clearing up litter costs the council over £2.8 million a year.

"We remain committed to enforcing littering around the town, and anyone spotted dropping cigarette butts, or any other kind of litter, will be challenged, investigated, and potentially face a fine.”

littering is an offence anywhere in the country - small items or big items. Have you seen the mess outside some pubs after closing time? disgusting. Cigarette ends are not biodegradable. If you would not drop it on the floor of your house - then don't drop it in our streets. Sorry. This legislation has been around in all towns and cities for a few years now and does include chewing gum - which I was taught as a child to wrap in a piece of paper until I could dispose of it. You can't have signs warning against every item which constitutes litter.

Why should there be signs, it is common sense not to throw litter about, having said that he could have just warned him not to throw his cig butt down, instead of standing there watching him do it, that is mean, like one reader states they need to go on the Town Hall Square, more so on a Saturday afternoon, it is a disgrace, and it is not locals most of the time.

Whilst I don't condone throwing litter of any kind on the floor and I agree that f you do you should be penalised I just can't get my head around Bolton councils double standards. It appears to me that they allow themselves to litter our beautiful town on a daily basis by allowing it's demise on such a grand scale.
Nothing is more unsightly as all the boarded up empty premises. The monstrosity of the ugly cinema apartments, the double standards as mentioned above re the crowds of foreign nationals loitering and intimidating locals by spitting at their feet looking ready to pounce on you if you dare to look at them
If we don't show respect and pride in our town centre how can we expect visitors to do the same.

Why does a grown man need a sign to tell him not to litter? I'm baffled! What chance do our young people have if this sort of behaviour is the 'norm' in our town. Yes the town centre is a dive and seems to be dying a slow, painful, & miserable death and I for one don't often go in especially after dark where it just doesn't feel safe anymore. Maybe it's a good thing for this chap to think twice about moving to our area. I hope the future is bright for Bolton, I really do. But looking at the present it's difficult to see it..

I'd bet my mortgage on this being *far* from the first offence. Mr Garbini is confusing "first offence", with "first time I got caught". Mr Garbini probably litters his fag butts (throwing them out of his car window etc), dozens of times a week and has done for years. It what most smokers do these days.

I don't drop litter or park illegally I was simply pointing out the lengths the council go to in order to create revenue,maybe you're one of the council parasites that loiter about in the undergrowth waiting to pounce on an unsuspecting wrongdoer

Using the sympathy angle. Crushed disc and living out of the area didn't stop him going to the Bolton News..........Well done Bolton Council.

As everyone is saying, this guy deserves what he got. Bolton or Newbury Berks. its always been on offence. What seems unfair is the size of the fine in relation to the scale of the offence. OK, there are costs involved to the council in policing this problem, but it would be interesting to know which offenders are targetted and which ones are turned a blind eye to. I would suggest that many many more fines would be handed out if the enforcer didn't just stick to easy targets where they aren't likely to give any hassle. How many times have they targeted the scum who stand on the Magistrates Court steps? £50 is what they'd expect to pay out for robbing my grannie!!! and that's when it's paid from out of their benefits over 12 months!

You seem to be confusing the role of the council with that of the police.

It's never been about the butts in the first place,otherwise they wouldn't have removed the ashtrays.(in many jurisdictions) Progressive (unbiased) gov's would have followed Vancouver's lead & installed recycling ashtrays.(others have had other programs) However,so called tobacco control has always been against anything that remedies this "problem" that they created.
