Agreement still binding on farmland

REGARDING Birtenshaw farmland, Bromley Cross.

Although Bolton Council, by its actions, stopped itself from enforcing the covenant, thus allowing 35 acres to fall to housing, the remainder stands protected.

I quote Mr Justice Scott in the Court of Justice 1990, “Mrs ‘Blank’ (a local resident) must rest content with the knowledge that the 1934 agreement continues to bind the rest of Birtenshaw farmland”.

So Bolton Council still have the legally binding and enforceable ace to play.
